These Terms and Conditions govern the use of the website www.novus-sim.com and the purchase of products through the online store operated by GT INDUSTRIES d.o.o. (hereinafter: “GT INDUSTRIES”, “we”, “us”, or “our”).

By accessing the website or placing an order, you agree to these Terms and Conditions. These Terms form an integral part of the purchase contract concluded between you (the “customer”) and GT INDUSTRIES.

The Terms and Conditions in force at the time of placing the order apply.

GT INDUSTRIES operates the website and online store and acts as the provider of e-commerce services.

2. Products and Pricing

Product descriptions, images, specifications, and availability may change without prior notice due to the nature of online business.

All prices are displayed in euros (EUR) and include VAT, unless explicitly stated otherwise.

Prices may change at any time. However, the price confirmed at the time of placing the order applies to the purchase contract.

Discounted items and promotional offers will be clearly marked.

Discount codes may be used during checkout where applicable. GT INDUSTRIES reserves the right to limit the use of discount codes or promotional campaigns.

Products purchased through the website are intended for end users only and may not be purchased for resale without prior agreement.

3. Order Process

To place an order, the customer selects products and adds them to the shopping cart.

During checkout, the customer provides:

  • contact information
  • delivery address
  • payment details

Before confirming the order, the customer can review and correct any information.

The order is placed when the customer confirms payment by clicking the final purchase button (e.g., “Pay now” or similar).

After the order is placed, the customer receives an order confirmation email.

4. Purchase Contract

A purchase contract between the customer and GT INDUSTRIES is concluded when:

  • the customer submits the order, and
  • payment is successfully completed or confirmed.

The contract consists of:

  • the order confirmation email
  • these Terms and Conditions

GT INDUSTRIES stores the order confirmation electronically.

5. Payment

Available payment methods may include:

  • credit or debit card
  • PayPal
  • bank transfer
  • other payment providers displayed during checkout

The customer receives an invoice or payment confirmation by email.

GT INDUSTRIES reserves the right to cancel an order if payment cannot be processed.

6. Shipping and Delivery

Orders are shipped using professional courier services such as UPS or equivalent international carriers, unless otherwise specified.

Shipping options and applicable shipping costs are displayed during checkout before the order is confirmed.

GT INDUSTRIES ships worldwide, subject to shipping availability and logistics conditions.

Due to the size, weight, and packaging requirements of simulator equipment and related hardware, orders may be shipped in multiple separate packages. This may improve handling during transport and reduce the risk of damage. Packages shipped within the same order may arrive at different times.

Orders are generally dispatched as soon as reasonably possible after the purchase contract has been concluded and payment has been successfully received.

Estimated delivery times for standard shipping are typically 3–15 business days, depending on the destination and order contents. Delivery times are estimates only and are not guaranteed.

Delivery delays may occur due to circumstances beyond our reasonable control, including but not limited to:

  • courier delays
  • customs inspections
  • international logistics disruptions
  • weather conditions
  • peak shipping periods.

For shipments delivered outside the European Union, additional import duties, taxes, or customs charges may apply. These charges are determined by the destination country and are the responsibility of the customer.

7. Damaged, missing, delayed, or lost shipments

Upon delivery, the recipient is responsible for inspecting the shipment and packaging as soon as reasonably possible.

If the shipment appears damaged, incomplete, delayed, or lost, the recipient must report the issue within 14 days from the delivery date.

If shipping damage or missing items are discovered, the recipient must follow the official courier claim procedure, which may include:

  • reporting the issue to the local courier office (e.g., UPS) within the required timeframe,
  • arranging collection or inspection of the shipment by the courier,
  • providing the package in its original packaging, and
  • providing photographic documentation of the damage.

The courier may collect the shipment and transport it to a local service center where the package will be inspected and an official damage report prepared.

Based on the courier’s report, the claim or compensation request will be processed in accordance with the carrier’s procedures.

Claims may also be submitted directly through the courier’s online claim system (for example, the UPS claim system).

The claim should include:

  • photos of the damaged item,
  • photos of the outer packaging,
  • photos of the inner packaging, and
  • clear images showing the damage.

If damage, missing items, delay, or loss are not reported within 14 days of delivery, and the official courier procedure is not followed, GT INDUSTRIES may be unable to process claims, replacements, or compensation requests related to the shipment.

If the recipient cannot arrange the courier procedure directly, they may contact info@novus-sim.com for assistance. GT INDUSTRIES may assist in arranging the inspection or collection of the shipment if the package is still available in its original packaging.

8. Right of Withdrawal (EU/EEA Consumers)

Consumers located in the European Union or European Economic Area have the statutory right to withdraw from the purchase within 14 days without providing a reason.

The withdrawal period begins on the day the goods are received.

To withdraw, the customer must notify GT INDUSTRIES by email at: info@novus-sim.com

Returned goods must be sent within 14 days after the withdrawal notice.

Customers are responsible for return shipping costs, unless otherwise stated.

Refunds will be issued within 14 days after receiving the withdrawal notice, but may be withheld until returned goods are received.

9. Exceptions to Withdrawal

The right of withdrawal does not apply to:

  • goods made according to the customer’s specifications
  • clearly personalized products
  • build-to-order simulator systems or custom configurations

Such products are manufactured or assembled specifically for the customer and cannot be returned unless defective.

10. Lack of Conformity (EU Consumers)

Consumers have legal rights if goods are defective or do not conform to the contract.

A product is considered non-conforming if it does not meet:

  • agreed specifications
  • expected functionality
  • quality typical for similar products

Consumers must notify GT INDUSTRIES within two months of discovering the issue.

Possible remedies include:

  • repair
  • replacement
  • price reduction
  • contract termination where legally applicable.

11. Product Use and Safety

Simulator equipment and motion systems contain mechanical and electrical components.

Users must ensure products are:

  • installed correctly
  • operated according to instructions
  • used in a safe environment with adequate space.

Improper installation, misuse, or unauthorized modification may result in damage, injury, or loss of warranty.

12. Commercial Use

Products sold through the website are intended primarily for personal use.

Commercial use (e.g., racing centers, gaming venues, rental services, events) may require separate agreements or licensing terms.

GT INDUSTRIES reserves the right to limit warranties or services for products used commercially without prior agreement.

13. Production Lead Times

Certain products may be manufactured or assembled after the order is placed.

Estimated production lead times may vary depending on:

  • component availability
  • supplier delays
  • production capacity
  • logistics conditions

Lead times provided on the website are estimates only.

14. Limitation of Liability

To the maximum extent permitted by law, GT INDUSTRIES shall not be liable for:

  • indirect or consequential damages
  • loss of profit or data
  • damages caused by misuse or unauthorized modifications
  • failures of third-party payment or logistics providers.

GT INDUSTRIES is liable only for direct damages caused intentionally or through gross negligence.

15. Force Majeure

GT INDUSTRIES shall not be liable for delays or failures caused by events beyond its reasonable control, including:

  • natural disasters
  • war or civil unrest
  • pandemics
  • supply chain disruptions
  • component shortages
  • transportation disruptions.

Delivery times and obligations may be extended for the duration of such events.

Personal data is processed in accordance with applicable data protection laws.

17. Complaints and Dispute Resolution

We aim to resolve disputes amicably.

These Terms and Conditions are governed by Slovenian law, except where mandatory consumer protection rules apply.

In case of disputes, the competent courts of Slovenia shall have jurisdiction unless otherwise required by law.

18. Order Acceptance and Fraud Prevention

GT INDUSTRIES reserves the right to review and verify orders before acceptance.

We may refuse, cancel, or limit any order if we reasonably believe that:

  • the order may involve fraudulent or unauthorized payment,
  • incorrect or incomplete customer information has been provided,
  • the order appears to violate these Terms and Conditions, or
  • the order involves resale or commercial distribution without authorization.

In such cases, GT INDUSTRIES may request additional verification, including identity confirmation or payment verification.

If an order is cancelled after payment has been processed, the customer will receive a refund using the original payment method, unless otherwise required by applicable law.

19. Payment Processing and Third-Party Services

Payments made through the website may be processed by third-party payment service providers, including but not limited to:

  • Stripe
  • PayPal
  • Shop Pay
  • Apple Pay
  • Google Pay
  • or other payment processors available at checkout.

By submitting payment information, the customer agrees to comply with the terms and policies of the selected payment provider.

GT INDUSTRIES does not store full payment card details and is not responsible for:

  • technical issues related to payment processing systems,
  • interruptions or failures of payment service providers,
  • delays caused by payment authorization procedures.

All payments are processed through secure encrypted payment systems operated by the respective payment providers.
